These Terms & Conditions (“Terms”) apply to the purchase and use of the Property Clarity Report provided by Price My Survey, a service operated by McBride Construction Ltd (“we”, “us”, “our”).
By purchasing, accessing, downloading, or using this report, you (“Client”, “you”, “your”) confirm that you have read, understood, and accepted these Terms in full.
1. Definitions
Property Clarity Report / Report: A written interpretation and cost summary based on your buyer’s survey.
Survey: The independent survey report provided by your surveyor (including RICS Level 2 or Level 3).
Property: The property address named within the Report.
Quoted Price / Costed Items: Any individual repair cost, allowance, or total figure included within the Report.
Unforeseen Works: Works required as a result of concealed, inaccessible, or unknown conditions discovered during opening up or commencement of works.
2. Nature of the Property Clarity Report (Not a Survey)
2.1 The Report is not a survey and does not replace your original Survey or any specialist inspection.
2.2 The Report provides an executive-level interpretation of the issues already identified in the Survey, with a cost context using Northern Ireland contractor pricing.
2.3 The Report is intended to support budgeting and proportionate negotiation. It is not a guarantee of transaction outcome.
3. Site Meetings & Property Walkthroughs (Client Contact Approach)
3.1 Where appropriate, we may arrange to attend the Property to meet the Client and review items referenced in the Survey.
3.2 You acknowledge that these visits are primarily for:
clarifying access and practical scope
improving accuracy of repair planning
allowing the Client to ask questions face-to-face
providing the option for McBride Construction Ltd to carry out the works if instructed
3.3 Unless expressly agreed in writing, any site meeting carried out does not constitute a full structural survey, valuation, or intrusive investigation.
4. Pricing Position – We Stand Over Our Figures
4.1 Where the Report provides specific costed items, you acknowledge that these costs are issued in good faith using our professional judgment and current Northern Ireland market pricing.
4.2 If McBride Construction Ltd is instructed to complete the works, we will stand over the costed items in the Report as our stated pricing position, subject to the conditions in sections 5 and 6.
4.3 The intention of this Report is to give Clients confidence that the figures are realistic and deliverable, not vague or inflated.
5. Validity of Costs (90 Days)
5.1 All prices and totals contained in the Report are valid for 90 days from the Report Date shown in the Report.
5.2 After this period, labour rates, availability, and material costs may change and pricing must be reviewed before works proceed.
6. Unforeseen Works / Hidden Defects (Very Important)
6.1 Construction works, particularly in older properties, may involve concealed or inaccessible defects which cannot reasonably be confirmed without intrusive inspection.
6.2 You accept that pricing and scope may require adjustment due to:
hidden rot, damp, or decay
concealed leaks
defective electrics discovered once opened
failed plasterwork behind finishes
structural movement not visible at time of inspection
asbestos-containing materials
drainage defects
unsafe or non-compliant historic alterations
sub-floor condensation or timber deterioration
roof defects under felt/battens not visible externally
6.3 Where unforeseen works become apparent, we will:
explain the issue clearly
provide revised pricing/options
proceed only with Client approval (unless emergency safety works are required)
6.4 Unforeseen works are not included in the Report costs unless specifically stated.
7. Provisional Sums, Monitoring Items & Specialist Reports
7.1 Where the Report states “provisional sum”, “monitor”, “specialist required”, or similar wording, such items are:
not confirmed defects
not a guaranteed scope of works
not cost-certainty items until further inspection is completed
7.2 The Client remains responsible for obtaining specialist inspections where the Survey recommends them (e.g., damp/timber, engineer, EICR, drainage CCTV).
8. Scope Limitations & No Intrusive Investigation
8.1 Unless confirmed in writing, no intrusive investigations are carried out as part of the Report process.
8.2 The Report does not include:
lifting floors
breaking out finishes
opening walls/ceilings
testing electrical circuits
pressure testing pipework
CCTV drainage inspection
8.3 The Client acknowledges that defects may exist which were not visible or referenced at the time of producing the Survey and Report.
9. Client Responsibility & Use of the Report
9.1 The Client remains solely responsible for their decision-making including:
whether to proceed with purchase
negotiation strategy
commissioning specialist inspections
appointing contractors
approving works and budgets
9.2 The Report is a support tool and should be used alongside:
the original Survey
solicitor advice
lender requirements
specialist reports where recommended
10. Limitation of Liability & Reliance (Plain English)
10.1 The Report is guidance only. While we stand over our pricing position as per section 4, we do not accept liability for decisions made by the Client based solely on the Report.
10.2 To the maximum extent permitted by law, Price My Survey and McBride Construction Ltd shall not be liable for:
purchase decisions taken by the Client
losses arising from defects not referenced in the Survey
concealed defects discovered after purchase
mortgage/lender valuation decisions
inability to negotiate reductions
delays, third-party actions or aborted transactions
10.3 No liability for decision outcomes:
You accept that we cannot be held liable for the outcome of any property transaction or negotiation, even where the Report is used as supporting evidence.
10.4 Where liability cannot legally be excluded, our maximum liability is limited to the fee paid for the Report.
10.5 Nothing excludes liability for death or personal injury caused by negligence, fraud, or any liability which cannot lawfully be excluded under Northern Ireland consumer law.
11. Third Party Reliance
11.1 The Report is prepared solely for the named Client and specific Property.
11.2 No third party may rely upon the Report, including estate agents, vendors, lenders, insurers, or subsequent purchasers.
11.3 If the Client shares the Report, the Client does so at their own risk.
12. Formal Quotation (If Client Instructs McBride Construction Ltd)
12.1 If the Client instructs McBride Construction Ltd to carry out works, we may issue a formal quotation or works schedule.
12.2 Any formal quotation will confirm:
scope of works
exclusions
start date availability
payment terms
variation process
compliance items (Building Control, etc., where applicable)
12.3 The Report itself is not a legal construction contract. It is an interpretive and pricing guidance document.
13. Fees, Delivery & Refunds
13.1 Payment is due in full before the Report is issued unless agreed otherwise in writing.
13.2 Once issued, the Report is a professional service and is non-refundable, except where required by consumer law.
14. Governing Law
These Terms are governed by the laws of Northern Ireland, and the courts of Northern Ireland will have exclusive jurisdiction.
15. Acceptance of Terms by Purchase and Conduct
By ordering or purchasing a Property Clarity Report through this website, you acknowledge and agree that:
You have had reasonable opportunity to access, read, and review these Property Clarity Report Terms and Conditions as made available on the website prior to purchase.
Your purchase of the Property Clarity Report constitutes electronic acceptance of, and agreement to be bound by, these Terms and Conditions, without the need for a physical signature or checkbox confirmation.
You understand and accept that the Property Clarity Report is not a survey.
You acknowledge that pricing is valid for 90 days only from the date of issue.
You understand that hidden, latent, or unforeseen defects may exist and may impact scope, recommendations, timeframes, and/or cost.
You accept and agree to the limitations of liability set out in these Terms and Conditions.
Following purchase, a copy of these Terms and Conditions will be provided to you electronically. You will have a defined review period, as set out herein, to notify us in writing if you do not agree to the Terms. Continued engagement with the Report or failure to notify us within that period will constitute confirmation of your acceptance.
